Who these terms cover

These terms apply to your use of this website and of the PayoutRange app, both published by Thesmos LLC, a United States company. By using either, you agree to them. If you do not agree, do not use them. The privacy policy explains how data is handled.

This website

The website is provided for information about Thesmos^™ and its software. You may read and link to it. You may not copy its design, text, or code to present as your own, or interfere with its operation. The simulator on the PayoutRange page is a demonstration. It is not the app, and its results are planning estimates only.

PayoutRange license

PayoutRange is licensed to you, not sold. Thesmos grants you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, through the App Store. Apple’s standard Licensed Application End User License Agreement applies to your use of the app and also governs where these terms are silent. You may not copy, modify, reverse engineer, rent, sell, sublicense, or distribute the app, except as the law allows despite this restriction.

Not advice

PayoutRange is a calculator and planning tool, not investment, tax or legal advice. It works on numbers you enter. It is not a broker, adviser, or fiduciary. It does not place trades, hold money or securities, or connect to any brokerage account. Nothing in the app or on this website is a recommendation to buy, sell, or hold any security. For decisions about your money, consult a licensed professional.

Estimates only

Every projection is an estimate drawn from the assumptions and figures you set. Simulated runs are not predictions. Real markets can do worse than the low end of a shown range. Tax figures are simplified illustrations for planning. You are responsible for what you type or import, and you agree to check share counts, prices, and dividends against your broker before relying on any figure. Your broker’s records control.

Market data

Prices and dividends in PayoutRange come from Tiingo, an outside data company, under its terms. The data is delayed, usually to the end of the day, and can be wrong, late, or missing. Dividend dates and amounts that have not been announced, and the yearly dividend, are PayoutRange estimates and are marked as estimates. The data is for planning only. It is not a quote or a trading feed. You can turn fetching off with Manual entry in Settings, Market data.

Purchases

PayoutRange has a free tier and an optional Pro subscription. Apple handles payment, and the price shown in the App Store at purchase applies. A subscription renews automatically until you cancel it. Cancel at any time in your Apple Account settings, under Subscriptions. Cancelling stops the next renewal, and Pro stays on until the end of the period you paid for. Refunds are decided by Apple; request one at reportaproblem.apple.com. Live market data is not part of Pro and may be changed, limited, or discontinued, with notice in the app where practicable. If Pro is discontinued, renewals stop, Pro keeps working to the end of the paid period, and we give notice in the app at least 30 days before.

No warranty

To the fullest extent allowed by law, this website and PayoutRange are provided as they are, without warranty of any kind, express or implied, including fitness for a particular purpose. Where the law of your location gives you a warranty that cannot be waived, that warranty is not excluded.

Limitation of liability

To the fullest extent allowed by law, Thesmos is not liable for investment losses, or for indirect, incidental, or consequential damages, arising from use of this website or the app. Nothing in these terms excludes liability that the law does not allow to be excluded.

Governing law

These terms are governed by the laws of the State of Louisiana, without regard to its conflict of law rules. Any dispute arising from these terms or from the website is brought in the state or federal courts located in Jefferson Parish, Louisiana, and you consent to their jurisdiction.

Changes

We may change these terms. The current version is on this page with its effective date. Changes to the app’s terms are shown in the app, and you are asked to accept material changes before you continue.
